Abstract
The legislative foundation of youth justice in Ireland is provided by the Children Act 2001, the first major legislative reform of the system since the Children Act 1908. The Act places emphasis on the prevention of offending behavior, the diversion of children from the formal justice system at the earliest stage, and the retention of detention as a measure of last resort. The main philosophy underpinning the ethos of youth justice is welfare oriented; however, in line with other jurisdictions across the world; the system embraces a diversity of approaches, including actuarial justice, crime prevention, punishment, restorative justice, and children's rights.
